What is considered domestic abuse?

A misconception is that domestic abuse only involves physical violence. However, under the Domestic Abuse Act 2021, the law recognises several forms of abusive behaviour that our domestic abuse solicitors can help you to protect yourself against. This includes: 

  • Physical or sexual abuse: This may include assault, physical harm, or non-consensual sexual activity
  • Coercive control: This is categorised as a pattern of acts used to harm, punish, or frighten you

  • Economic abuse: Unfairly controlling somebody’s ability to acquire, manage, or use their money can be seen as abusive in a court of law
  • Psychological or emotional abuse: This often comes in the form of ‘gaslighting’ (when somebody is made to doubt their own sanity), but can also include verbal insults or threats of self-harm

Domestic Abuse Solicitor FAQs

 A non-molestation order is a type of injunction issued to protect a victim (and any relevant children) from being harassed, threatened, or intimidated by an abuser. It prevents the abuser from coming near the victim’s home or contacting them. Breaching a non-molestation order is a criminal offence that can result in an arrest.

While a non-molestation order protects your person, an occupation order deals with the home. It can grant a victim the right to stay in the family home and order the abuser to leave, regardless of who legally owns the property or whose name is on the tenancy agreement.

In many cases, an initial application for an injunction can be made “ex-parte” (without notice), meaning the abuser is not present for the first hearing. However, a full hearing will usually follow, where both parties can give their accounts. Our domestic abuse solicitors aim to make this process as stress-free as possible, often using special measures like screens or video links so you do not have to see the other party.

In emergency situations where there is an immediate risk of harm, a court order can often be obtained on the same day the application is made. For non-emergency cases, the process may take several weeks as the court needs to schedule hearings and allow for the service of papers.
