So, what is an Occupiers Consent Form and why is it necessary? An occupier is any adult living in a property who is not the legal owner. Though not on the mortgage, an occupier can still try to claim legal interest in a property. An Occupiers Consent Form, also known as a Deed of Postponement, protects the lender and helps to mitigate borrowing risk. It confirms that the occupier’s interests will not interfere if the owner cannot repay the mortgage and the property needs to be repossessed.

Unless the lender states otherwise, the occupier cannot instruct the buyer’s or lender’s conveyancing solicitor and must seek independent legal advice.
