The prospect of selling property can be daunting. There are various stages to the process selling leasehold property and these can be put very simply as follows:-

At the outset of the transaction, you will be asked to complete various forms which provide your Buyer with information about the property, from whether you have had any work done at the property requiring planning permission or building regulation approval to what you are leaving at the property in terms of contents. You will also be asked to complete a form providing details of the Freeholder, any Managing Agents and general information regarding the leasehold arrangements. If you are aware that the Managing Agents/Freeholder, Management Company provide a standard pack designed for legal representatives in a sale, then it is useful to obtain that pack early on. It is always helpful if the Seller provides as much information as early in the sale as possible. Once we have received the completed forms the following stages apply:-

  • Submission of draft contract for approval with supporting documents including forms completed by the Seller.
  • Providing replies to the Buyers lawyer’s enquiries (generally with the Seller’s help) and with input from the Freeholder/Managing Agents/Management Company

Once the above stages have been completed all parties will sign contract papers and proceed towards an exchange of contracts with an agreed completion date. Between exchange of contract and completion where there is a mortgage we will need to obtain an up to date figure from the Lender to redeem on completion and you will be asked to sign a Land Registry transfer document. It may also be necessary for us to work out apportionments in terms of sums paid on account of ground rent and service charges. On completion as well as paying off your mortgage, we will generally also pay the Estate Agent’s account where we have sufficient funds.
