Landlords should be aware as to the importance of ensuring that your tenant deposit on an AST has been paid into a designated deposit scheme. This must be done within 30 days from the commencement of the tenancy. If in the event you as a Landlord wish to obtain possession of your property at the end of the term and you have not protected your tenant’s deposit, the only way in which you can proceed to serve a valid section 21 notice to evict would be for you to return your tenant’s deposit in its entirety. Upon returning the deposit, you can then proceed
to serve a valid section 21 notice to evict.
