Divorce is not always appropriate and separation can be a more preferable option for a variety of reasons. A Separation Agreement is a contract drawn up between the parties providing that the parties live separate and apart. It is based in contract law and can provide for division of the matrimonial assets and provide for a divorce at some point in the future. Although the Matrimonial Courts retain jurisdiction within divorce proceedings, case law has shown that Courts are reluctant to go behind the terms of a properly drafted Separation Agreement where both parties have had independent legal advice and there has been full disclosure of the financial assets.
