A Pre-nuptial agreement is a written agreement that can be entered into between couples who intend to marry. The agreement will lay out how they will arrange their finances and how they intend their assets and property to be divided out if their intended marriage were to break down and fail.
A couple can also enter into a Post-nuptial agreement. It is essentially the same thing except it has been entered into after the marriage has taken place.
A pre-nuptial agreement is a sensible way of attempting to protect your assets – and can save on expensive litigation at a later date. Although not legally binding, the Courts can place a significant weight on a pre-nuptial agreement – in recent cases the courts have taken prenuptial agreements into consideration as one of the circumstances which the court will bear in mind when deciding on the division of matrimonial assets.
When deciding the weight, if any, to be place on a pre-nuptial agreement the court will consider a number of factors, including:-
- did the parties have independent legal advice
- did they have a clear picture of their finances
- how long before the wedding was the agreement signed, and
- was either party under financial or emotional pressure to sign?
